What is this case about?

A class action lawsuit, Michael Ewert v. eBay, Inc., was filed on April 20, 2007 in the United States District Court, Northern District of California, San Jose Division, on behalf of eBay customers who did not receive the full duration of auction time that they selected and paid for, and who did not have their auction(s) start when their listing was submitted. The complaint alleges that eBay engaged in deceptive, unfair and oppressive business practices directed at eBay customers who used eBay's "Online Auction Format," that eBay did not disclose to consumers that auctions would NOT begin when a listing was submitted, and that consumers would NOT receive the full duration of auction time as selected on eBay's "Online Auction Format."

Some of the unfair practices alleged against eBay include: deceiving consumers into believing that eBay would start an auction when the listing was submitted, deceiving consumers into believing that they would receive the full amount of auction time that they selected, misrepresenting the terms, conditions, restrictions or procedures under which goods would be sold at auction, advertising eBay auction services with the intent not to sell them as advertised, failing to adequately disclose to consumers that auctions would not start when submitted, and failing to adequately disclose to consumers that an auction would not be open to bidders for the full time that they selected. Plaintiff, Michael Ewert, seeks to enjoin eBay's unlawful activities and recover damages on behalf of himself and all persons who were harmed. What is the eBay Class period? Who is in the eBay Class?

The Class is defined as all eBay customers beginning four years prior to the date of filing suit, who used eBay's auction house and auctioneer services and the "On line Auction Format," did not have their auctions made available to receive bids when submitted, and paid for but did not receive the full duration of the auction time selected.

What is a lead Plaintiff?

A lead plaintiff is a representative party that acts on behalf of other Class members in directing the litigation. In order to be appointed lead plaintiff, the Court must determine that the Class member's claim is typical of the claims of other Class members, and that the Class member will adequately represent the class. Under certain circumstances, one or more Class members may together serve as "lead plaintiff." Your ability to share in any recovery is not, however, affected by whether or not you personally serve as a lead plaintiff.
